This klientx Terms of Services is a binding contract between you and klientx, Inc. Your use of the Klientx website and all of the goods and services provided by Klientx Inc. is governed by the following Terms of Service.
You are not permitted to access or use the klientx website or the services offered here if you disagree with these Terms of Service. You accept and agree to be governed by these conditions of Service and any additional conditions applicable to the individual services you register for by using the klientx website or its services. Please check back periodically as these Terms of Service may be amended from time to time. You understand and consent to the fact that using the Klientx website and services after any such modification indicates that you accept the updated Terms of Service.
You acknowledge that you have read and agree to the terms of service for this website and its services by using it. Please do not use this website if you disagree with these terms.
Klientx Inc., doing business as Klientx, is responsible for maintaining the Klientx service, which enables website owners to track and communicate with website visitors.
1. Any unauthorized use of the service, including sending communications with racist or discriminatory material, is absolutely forbidden. Any such use might be construed as harassment of a person or an organization.
2. You are in charge of protecting the confidentiality and storage of your password and login.
3. You acknowledge and agree that any actions associated with your username and password are considered to have been carried out by you and are binding on you legally.
4. You agree to be legally responsible for the content of your messages in compliance with generally applicable laws. Klientx disclaims any responsibility for the communications transmitted and their contents. You release Klientx from any liability arising from any claims made by third parties due to the content of the messages. You alone will bear the consequences. Klientx has the right to bar you from making use of this service.
5. You understand that Klientx provides the service through major mobile network providers and telecommunications firms, and as such, it can only affect message delivery transmission within the technical limitations set by the aforementioned providers.
6. KlientX messages sent online will eventually reach the designated mobile recipients, given that the recipient’s phone is turned on and in a service region that is serviced by his mobile network provider. You understand that there’s a chance the message won’t reach the receiver successfully, based on the service provided by their cell operator.
7. Klientx makes no warranties or promises regarding the performance or availability of this service. Although Klientx will do all in its power to send the message on time, it disclaims all responsibility for message failures or transmission delays.
8. In accordance with legal requirements, usage data is recorded for the necessary purposes of maintaining the messaging service.
9. You bear all risk associated with using the service.
10. You guarantee every end user the right to object to your processing of personal data relating to the end user and processed for the purposes of direct marketing. klientx is firmly committed to protecting the privacy of your personal information and the personal information of your customers. By using klientx, you acknowledge and agree that klientx’s collection, usage and disclosure of this personal information is governed by our Privacy Policy.
Furthermore, if
(a) the European Economic Area (EEA) is where you are based;
(b) you offer products or services to clients in the European Economic Area; or
(c) The EU General Data Protection Regulation’s rules apply to you in any other case, and our Data Processing Addendum governs how Klientx collects and uses personal data belonging to any European resident.
11. You warrant that the content of any message will always uphold and not in any way violate the fundamental human rights guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms as well as by any national laws that apply to our business (such as the right to privacy and the prohibition against discrimination on the basis of sex, race, color, language, religion, political opinion, or national or social origin).
12. By using the klientx website and services, you agree to violate these Terms of Service, break any laws, regulations, or third-party rights, and to defend, indemnify, and hold harmless klientx, their officers, directors, employees, agents, and partners from and against any third-party claims, actions, demands, liabilities, expenses, and costs, including without limitation reasonable legal and accounting fees.
13. Your only option is to stop using the website and services if you disagree with our terms of service, our website, or any of the Klientx offerings.
14. Without notice, cost, or liability, Klientx retains the right to modify, alter, change, suspend, remove, enhance, supplement, disable access to, terminate, or discontinue all or any portion of the Klientx website and/or services at any time. As long as these modifications do not materially and adversely affect your rights or obligations under these Terms of Service, Klientx will not be held liable. In the event that the klientx website or services are modified or discontinued, klientx shall not be responsible to you or any other party.
15. You understand and accept that klientx is the exclusive owner of the Service, including all relevant copyrights, patents, trademarks, trade secrets, database rights, treaties, and other related intellectual property. In carrying out its duties under this Agreement, Klientx may acquire personally identifiable data; such data may only be used in compliance with Klientx’s then-current privacy policy. You understand that using the Service does not give you any ownership rights to the intellectual property included in it.
16. You acknowledge that the klientx Service & Software includes private and proprietary data that is covered by relevant intellectual property laws as well as other legal protections. klientx provides you a limited, non-exclusive license to use the Software only for the purpose of accessing and using the Service in accordance with these Terms for the duration of this Agreement, subject to the terms and conditions of this Agreement.
17. No refunds or credits for Subscription Charges or other fees or payments will be provided to You if You elect to downgrade or cancel your service plan. Downgrading Your Service Plan may cause loss of content, features, or capacity of the Service as available to You under Your Account, and klientx does not accept any liability for such loss.
You commit to abstaining from all of the following:
Take a copy of the Service’s source code or content. Disassemble, modify, decompile, replicate, or create duplicates of the Service or the Site; reverse engineer (or attempt to find the source code of the Service); harass, intimidate, humiliate, or otherwise upset or unsettle any End User or other person or organization, Use any method to access the Service apart from the interfaces that Klientx has made available for use in doing so. Falsely portray your association with any other person or entity, or impersonate any other person or entity, including without limitation any official from Klientx; Send unsolicited mass emails (spam) that contain a link to the website, the service, or a web page that has a link to the website (including button codes or monitor tags). Change the Klientx widget in ways that are not covered by the dashboard’s customization options. Eliminate or modify the Klientx branding and logo in any manner from the Klientx pages or widgets.
